REGISTRATION AND RULES | TERMS AND CONDITIONS

You hereby understand and agree to the following:

  1. Promoter: The Thu Thiem Competition is promoted by the Investment and Construction Authority of the Thu Thiem New Urban Area. The Promoter shall control and supervise the competition and approve the jury's decision. 
  2. Professional Advisor: The Promoter has nominated Sasaki Associates, Inc. as the Professional Advisor to administer the operation of the competition and adjudication process.

    The duties of the Professional Advisor for the competition include monitoring the competition so that all procedures and regulations are observed and supervising communications between the competitors and the Promoter/Organizer. The Professional Advisor will support the operation of the jury and technical committee.
  3. Technical Committee: The Promoter will designate members of a Technical Committee who will undertake review of the submissions for any violations of the regulations. The result of the Technical Committee's screening will be reported to the Jury. The Technical Committee does not have any right to directly disqualify entries of have any voting rights.
  4. Conflict of Interest: All those likely to be in conflict of interest, including but not limited to the following, are excluded from the Competition:
    • Employees of the Promoter of Organizer of the Competition
    • Anyone closely associated with the preparation of the Competition brief
    • Anyone having immediate family ties to a member of The Promoter, Organizer, or Jury
  5. Disqualification: The Promoter reserves the right to disqualify any submission for cause including, but not limited to, the following:
    • Submission is received after the date and time specified
    • Submission is not the original effort of the submitting architects
    • Submission is not made in the name of the architect who pre-registered
    • Submission fails to meet basic program, technical requirements, or conditions
    • Submission boards disclose the architects identity, the identity of consultants, or improperly attempts to influence the Jury's decision
  6. Copyright and Ownership: The competitor permits the Promoter to use photos, pictures, and drawings of the design partially or fully for publication, advertisement, or exhibitions in Vietnam or abroad. By signing the Entry Form, the competitors have given their consent to the Promoter to use the entry designs for exhibition and publication. The Promoter shall retain all submitted works.
  7. Agreement: The winning entrant has the right to negotiate a schematic design contract for the Central Plaza, Crescent Park, and Pedestrian Bridge with the Promoter. If necessary, the Promoter can request a complement to the design team to meet domestic legal requirements for the agreement.
  8. Law and Jurisdiction: The Competition shall take effect under, and be construed and enforced according to the laws of Vietnam. Any dispute or differences between relevant parties in connection with this Competition shall be submitted to the exclusive jurisdiction of the Vietnam courts.
  9. Legal Basis: Document No 1278/UBND-ĐTMT dated 02/27/2008 from HCMC People’s Committee for the organization plan of the international design competition for Central Plaza, Crescent Park and Pedestrian Bridge.
    Decision No 11/QĐ-BQL dated 03/10/2007 from Thu Thiem ICA for approval of the organization plan of the international design competition for Central Plaza, Crescent Park and Pedestrian Bridge.
  10. Type of Competition: The International Design Competition for Thu Thiem New Urban Area: Central Plaza, Crescent Park, and Saigon River Pedestrian Bridge is an open, two-stage Competition for qualified professional architecture, landscape architecture, urban design, planning, and engineering firms or teams. The Competition encourages entries from joint ventures (between Vietnamese companies or between Vietnamese companies and foreign companies).

    The first stage will be anonymous, open and unpaid. Six (6) shortlisted firms will be selected and paid to continue (anonymously) with the second stage. A winner will be selected from the six (6) shortlisted submissions. The winner will have the right to negotiate the Design Contract with the Competition Sponsor for development of the project. (If the winner is internationally based, they will be required to select a local consultant to be a subcontractor in a supporting role).
  11. Anonymity: To ensure the anonymity of the projects, entrants must abide by the following:
    All design submission boards and wrappers shall be free of any identifying marks whatsoever. Entries shall not bear any motto, logo or distinguishing marks of any kind to identify the firm submitting the design.
  12. Languages: The official language of the Competition is English. Vietnamese text may be incorporated on the boards or within the narrative text submittal at the discretion of the Competitors.
  13. Exhibition: Competitors should retain copies of all work. It is the intent of the Competition sponsor to hold a Competition exhibition at the conclusion of the Competition.
  14. Negotiation After the Competition: The winning Competitor will be asked to submit a formal design development proposal to the Competition sponsor at the conclusion of the Competition. A formal Request for Proposal (RFP) will be established by the sponsor for the winning entrant. A negotiation period will follow, in order to clarify scope, schedule, and fees for the ongoing design tasks.
